TERMS AND CONDITIONS
Bear Spray Rental
1. Definitions
"Company" means Whistler Hardware Inc. and its agents.
"Renter" means the individual or group renting the Bear Spray.
"Bear Spray" means a wildlife deterrent spray containing capsaicin housed in aerosol canister and any associated accessories provided for rent by the Company.
"Rental Period" means the dates and times specified at the time of booking.
“Replacement Cost” means the retail sales price at Whistler Hardware for a 225g Yukon Magnum bear spray, the Holster, and Carabiner clip.
2. Regulation
Bear deterrent sprays (Bear Spray) are categorized as household aerosols under Pest Management Regulatory Agency (PMRA) Canada. Improper use, storage, or disposal can cause serious injury. The Renter must comply with all applicable local, provincial/territorial, and federal laws and regulations regarding the possession and use of bear spray.
3. Eligibility
To rent Bear Spray, the Renter must:

Be 19 years of age or older (government-issued ID required at pickup).

Agree to and sign a rental agreement and Release Agreement.

Not be under the influence of alcohol or controlled substances at the time of pickup.

Complete the provided safety orientation or watch a referenced instructional video.
4. Permitted Use
Bear Spray is intended solely for the purpose of deterring bears and wildlife encounters in backcountry and outdoor recreation settings. The Renter agrees to:

Use Bear Spray only as directed in the manufacturer's instructions, as noted on canister label.

Keep the Bear Spray accessible (e.g., in a belt holster) and not stored inside a pack while in bear country.
5. Prohibited Use
The Renter must NOT:

Use Bear Spray as a weapon against any person.

Deploy the Bear Spray indoors, in enclosed spaces, or in vehicles.

Test the rental canister of Bear Spray.

Tamper with, disassemble, or modify the canister or safety clip.

Transport the Equipment on commercial aircraft or in violation of transportation regulations.
6. Condition of Equipment
The Renter acknowledges that Bear Spray is part of a rental fleet and has been handled by unknown third partiers. The Renter is responsible for inspecting the can and confirming it is in serviceable condition at the time of pickup and protecting the can while in their ciu.

Inspect the canister for visible damage, corrosion, or tampering at pickup and immediately report any concerns to Company staff.

Check the weight of the cannister and ensure it is at least 210 grams.

Treat the Bear Spray canister with reasonable care throughout the Rental Period.
7. Testing, Accidental Discharge, or Use
The Renter is financially responsible for any use of the Bear Spray, whether intentional or deliberate, during the Rental Period, including:

Accidental discharge: full replacement cost of the canister.

8. Loss or Damage
The Renter is responsible for the Equipment from the moment of pickup until it is officially checked in by Company staff. In the event of loss or theft, the Renter will be charged the full replacement cost (same as full retail price). Physical damage to the canister (dents, cracked nozzle, broken clip) will be assessed by the Company and may result in he Renter will be charged the full replacement cost.
9. Return of Equipment
Equipment must be returned:

In the same condition as received, with the safety clip intact and the canister un-deployed.

With the weight of the canister being equal to or greater than ____ grams.

To the designated return location agreed upon at booking.
Late returns will be charged at the applicable rental rate for the duration the Renter had the Bear Spray in his/her possession. Equipment returned with the canister partially or fully deployed will be treated as used/damaged and the Renter will be charged the full replacement cost.
If the rental is not returned within 14 days of the start of the rental period, the Renter will be charged the full replacement cost.
10. Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity and Defence Agreement
The Renter acknowledges that the associated Release Agreement must be completed and signed. Failure to complete the Release Agreement will result in a cancellation of the rental booking.
11. No-Show Policy
Failure to collect the Equipment within 12 hours of the scheduled pickup time, without prior notice, will be treated as a no-show. No refund will be issued for no-shows.
12. Refund Processing
Approved refunds will be processed to the original payment method within 1 business day. The Company is not responsible for delays caused by the Renter's financial institution. If paying by bank debit card, some financial institutions take 3 to 5 business days to process the refund to your bank account.
13. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any dispute arising from this agreement shall be subject to the exclusive jurisdiction of the courts of British Columbia.
14. Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect.
CANCELLATION POLICY
Cancellation by the Renter
Cancellations must be submitted in writing (email or online portal) referencing your booking confirmation number. The following schedule applies:

How to Cancel:

Email: rentals@whistlerhardware.ca with subject line: CANCEL – [Booking #].

Online: log in to your account and select 'Cancel Booking'.

In person: present your confirmation to any front-desk staff during business hours.
Modification of Booking
Renters can reschedule a booking anytime for no additional charge by emailing the Company at rentals@whistlerhardware.ca or logging in to your account and select ‘Modify Booking'.
Cancellation by the Company
The Company reserves the right to cancel a booking in the following circumstances:

Equipment is unavailable due to damage or recall.

Force majeure events (wildfire evacuation orders, natural disasters, etc.).
In the event of Company-initiated cancellation, the Renter will receive a full refund of all fees paid within 1 business day, or the option to reschedule at no additional charge.
